Algemene voorwaarden

Met het accepteren van de algemene voorwaarden verklaart u nadrukkelijk kennis te hebben genomen met de algemene voorwaarden, huisregels en betalingsafspraken van VOF GymBokx en zich hieraan te zullen houden. Het lidmaatschap eindigt pas als de overeengekomen contractperiode wordt opgezegd zoals omschreven in onze algemene voorwaarden. Het lidmaatschap eindigt dus, los van het feit of u wel of niet traint, niet automatisch!

Artikel 1: Lidmaatschap

1. Ingang:
   1.1 Elk lidmaatschap start op de dag van inschrijving. Elk lidmaatschap gaat in op de 1e van de maand. Indien u lid wordt gedurende de lopende maand, wordt naar rato (pro-rato) een gebroken maandbedrag in rekening gebracht, waarna per de eerste van de volgende maand de eerste termijn van het lidmaatschap (maand, kwartaal of jaar) in gaat.
   1.1.2 Elk lidmaatschap wordt verplicht afgenomen voor de minimale duur van één volledige kalendermaand.
2. Duur:
   Basic Jaar ineens: 12 maanden (+ pro-rato periode) 24,95 pm
   Basic Jaar per maand: 12 maanden (+ pro-rato periode) 26,95pm
   Basic maand: 1 maand (+ pro-rato periode) 39,95pm
   Basic kwartaal ineens: 3 maanden (+ pro-rato periode) 30,95pm
   Basic kwartaal per maand: 3 maanden (+ pro-rato periode)31,95pm
   Premium jaar ineens: 12 maanden (+ pro-rato periode) 44,95pm
   Premium jaar per maand: 12 maanden (+ pro-rato periode) 46,95pm
   Premium maand: 1 maanden (+ pro-rato periode) 59,95pm
   Student Basic Jaar per maand: 12 maanden (+ pro-rato periode) 20,-pm
   Student Premium Jaar per maand: 12 maanden (+ pro-rato periode) 35,-pm
   

   Alle lidmaatschappen lopen voor de volledige afgesloten periode waarbij de einddatum evenredig aan de duur van eventuele pauzeringen wordt opgeschoven.

Artikel 2: Bedenktijd/ herroeping

1. Gedurende de bedenktijd van 14 dagen na (digitale) ondertekening van de overeenkomst, heeft u de mogelijkheid om de overeenkomst kosteloos te herroepen.
2. Voornoemd herroepingsrecht eindigt op het moment dat u gebruik maakt van de faciliteiten binnen de 14 dagen van het herroepingsrecht.

Artikel 3: Verlengen/ upgraden lidmaatschap

1. Alle lidmaatschappen worden automatisch stilzwijgend per maand verlengd na de eerste afgesproken periode.

2. Contractduur en verlengingen begeleidingspakketten:
   Begeleidingspakket A: contractduur 2 maanden, verlengd per maand
   Begeleidingspakket B, C en D: contractduur 4 maanden, verlengd per maand
3. Get in Shape lidmaatschappen zijn 13 weken waarvan 12 weken voor training en 1 week voor testen en meten.
4. Het omzetten van uw basislidmaatschap kan na de contractueel afgesproken termijn per kalendermaand. U dient hiervoor het verlengformulier in welke te vinden is in de link of via de FAQ op de website. Indien niet tijdig schriftelijk is omgezet, wordt het lidmaatschap automatisch stilzwijgen verlengd (zie artikel 3.1). Tijdens deze periode blijft de verplichting bestaan de verschuldigde contributies aan GymBokx te voldoen, ook wanneer er mogelijk geen gebruik wordt gemaakt van de faciliteiten.

Artikel 4: Upgraden lidmaatschap.

1. Het is mogelijk om uw Basic lidmaatschap te upgraden naar een Premium lidmaatschap, binnen de gekozen contractperiode. U sluit dan een nieuw termijn af van 1 jaar. Het is niet mogelijk om uw lidmaatschap te downgraden.

 Artikel 5: Opzegging lidmaatschap

1. Opzeggen kunt u via de FAQ op de website gymbokx.nl. Indien wij uw opzegging hebben verwerkt, ontvang je hiervan binnen 5 werkdagen een e-mail bericht ter bevestiging. Deze e-mail is bindend. Zonder deze bevestiging is uw opzegging niet geldig. Heeft u geen bevestiging ontvangen dan is het aan u om contact op te nemen met GymBokx. Tot die tijd blijft u betaal plichtig.
2. Opzeggen kan na de contractueel afgesproken termijn per kalendermaand. Indien niet tijdig is opgezegd, wordt het lidmaatschap vervolgd voor de afgesproken periode. Tijdens deze periode blijft de verplichting bestaan de verschuldigde contributies aan GymBokx te voldoen, ook wanneer er mogelijk geen gebruik wordt gemaakt van de faciliteiten. Tussentijds opzeggen is niet mogelijk. Het volledig aantal maanden incl pro-ratoperiode moeten ten alle tijden worden voldaan.
3. GymBokx hanteert geen opzegtermijn.

Artikel 6: Pauzeren lidmaatschap

1. Lidmaatschappen kunnen maximaal één keer per kalenderjaar worden gepauzeerd, met een maximum van 3 aaneengesloten kalendermaanden, op vertoon van een medische verklaring. U kunt deze pauzering aanvragen via de website https://gymbokx.nl/pauzeren/ waar u ook uw in gescande medische verklaring in kunt dienen.
2. Achteraf pauzeren van een lidmaatschap is niet toegestaan. Het aanvragen van de pauzering dient vóór de pauzeringsperiode te geschieden. Verleende pauzeringen gaan direct in of vanaf de eerste van de daaropvolgende kalendermaand.

Artikel 7: Lidmaatschap strikt persoonlijk

1. Het lidmaatschap heeft uitsluitend betrekking op de vermelde activiteiten en de aangegeven duur en prijs. Tenzij uitdrukkelijk anders bepaald, is het lidmaatschap strikt persoonlijk, niet overdraagbaar en alleen te gebruiken door en voor de afnemer van het lidmaatschap en de clubpas.
2. Ter aanvulling op artikel 7.1 is het doorgeven van een clubpas, en daarmee een lidmaatschap, aan een ander strikt verboden. Bij het overtreden van deze regel maakt u zich schuldig aan het plegen van fraude. Zie artikel 18.

Artikel 8: Afspraken

1. Met GymBokx gemaakte afspraken dienen uiterlijk 24 uur voor aanvang te worden afgemeld. Wanneer niet nagekomen of tijdig afgezegd, zal de credit voor deze afspraak komen te vervallen.
2. Wanneer een nieuwe afspraak is gewenst dient er door de klant opnieuw een credit te worden gekocht.
3. Personal Training afspraken, die zoals vernoemd in artikel 8.1 tijdig zijn afgemeld, kunnen enkel ingehaald worden binnen de termijn die contractueel overeengekomen is. Zie artikel 3.2.

Artikel 9: Openingstijden & tarieven

1. GymBokx is te allen tijde gerechtigd de openingstijden, lesroosters en tarieven te wijzigen. Tijdens officiële feestdagen behoudt GymBokx zich het recht voor de club te sluiten, zonder dat dit zal leiden tot vermindering van contributie of eventuele teruggave hiervan.
2. Wijzigingen van tarieven zullen worden doorgevoerd voor de nieuwe én lopende lidmaatschappen.
3. Een keer per jaar, vanaf 1 januari, mogen wij onze tarieven verhogen met maximaal 5% (exclusief de hoogte van het CBS-prijsindexcijfer voor gezinsconsumpties) per jaar vanaf de laatste tariefsverhoging. Indien wij daarvan gebruik maken, geeft dat geen recht de overeenkomst te beëindigen, tenzij de tariefsverhoging binnen drie maanden na het sluiten van de overeenkomst plaatsvindt of hoger is dan 5% (exclusief de hoogte van het CBS-prijsindexcijfer voor gezinsconsumpties). Tarief aanpassingen vanwege overheidsmaatregelen zoals BTW verhoging, zonder daarmee andere overheidsmaatregelen uit te sluiten, kunnen onmiddellijk worden doorgevoerd ongeacht de hoogte en geven geen recht op ontbinding.
4. De coulance regeling bij verhoging binnen 3 maanden is het nieuwe bedrag per maand delen door het restant openstaande bedrag van het initiële lidmaatschap waardoor er een kortere lidmaatschapsduur overblijft en je niet meer dan het totaalbedrag van je gehele lidmaatschap dat initieel is afgesproken betaald.
5. indien er geen schriftelijk bezwaar wordt gemaakt binnen 4 weken na de aankondiging van de verhoging ga je akkoord met de prijsverhoging en vervalt het recht op coulance of tussentijdse stopzetting.

Artikel 10: Betaling

1. Door akkoord te gaan met onze algemene voorwaarden geeft u toestemming aan de vestiging van GymBokx waar u uzelf inschrijft om doorlopend incasso-opdrachten van uw rekening af te schrijven overeenkomstig de opdracht van GymBokx. Als u het niet eens bent met deze afschrijving kunt u deze laten terugboeken. Neem hiervoor binnen acht weken na afschrijving direct contact op met uw bank. Vraag uw bank naar de voorwaarden.
2. De betaling van uw lidmaatschap geschied voor de eenmalige kosten en pro-rato termijn van uw lidmaatschap direct bij inschrijving, en uiterlijk voor uw eerste bezoek middels betaling via ideal of middels automatische incasso.
3. Alle lidmaatschappen worden na de eerste termijn (artikel 10b) volgens de door u gekozen wijze automatisch verlengd middels automatische incasso. Om die reden bent u verplicht tot het opgeven van uw IBAN voor de maandelijkse incasso na deze termijn en derhalve bent u gehouden zorg te dragen voor voldoende saldo op uw rekening waarvan GymBokx gemachtigd is te incasseren.
4. De verschuldigde contributie wordt per maand, per kwartaal of per jaar (ineens of per maand) vooraf automatisch geïncasseerd.
5. Indien GymBokx twee opeenvolgende incasso-opdrachten geen betaling heeft ontvangen is het volledige resterende bedrag van het gehele lidmaatschap opeisbaar en zal een incassobureau ingeschakeld worden. De kosten hiervan komen voor uw rekening. De toegang tot GymBokx zal worden geweigerd tot de betaling voldaan is.
6. De incasso van verschuldigde bedragen die niet worden voldaan binnen de door GymBokx gestelde termijnen, worden overgedragen aan een incassokantoor. Alle gerechtelijke en buitengerechtelijke (incasso)kosten die GymBokx moet maken als gevolg van de niet-nakoming, komen geheel ter uwer laste. De vergoeding van buitengerechtelijke kosten wordt gefixeerd op 15% van de verschuldigde hoofdsom (met een minimum van € 40,00 per vordering). Daarnaast zal vanaf de datum van verschuldigdheid wettelijke rente in rekening worden gebracht over de hoofdsom.
7. Indien GymBokx geen automatische incasso kan uitvoeren of in geval van stornering behoudt GymBokx zich het recht uw lidmaatschap per direct op te zeggen en een incassokantoor in te schakelen.

Artikel 11: Resultaatgarantie & Tevredenheid garantie

1. Resultaatgarantie is enkel van toepassing wanneer er aan de volgende voorwaarden is voldaan:

In geval van het Get in shape programma

• 100% van de trainingen dienen door u, zoals voorschreven, te zijn uitgevoerd. Dit betreffen 36 trainingen waarvan 24 small group trainingen en 12 fitnesstrainingen;
  • 100% van de voorgeschreven (84) dagen dient u uw voeding in te vullen in de daarvoor bestemde FOOD app;
  • Uw weekscore in de FOOD-app dient elke week minimaal 90% te zijn.

In geval van de begeleidingspakketten

• 90% van de trainingen (3x per week) dienen door u, zoals voorgeschreven, te zijn uitgevoerd.
  • 100% van de dagen dient u uw voeding in te vullen in de daarvoor bestemde FOOD app
  • Uw weekscore in de FOOD-app dient minimaal 90% te zijn.

Iedere positieve verandering valt onder resultaat. Hieronder vallen dus   veranderingen in gewicht, vetmassa, spiermassa, vetpercentage,           spierpercentage, verandering in de omtrek van buik, benen en armen,     verbetering in scores op de conditietest (roeitest) en krachttesten.

1. Tevredenheid garantie is enkel van toepassing wanneer er aan de volgende voorwaarden is voldaan:
   – Alleen van toepassing op Basic Jaar betalen per maand en Premium Jaar betalen per maand
   – minimaal 24 trainingen van minimaal 30 minuten in 3 kalendermaanden door het lid dat aanspraak wil maken op de garantie.
   – Wanneer gebruikt wordt gemaakt van de garantie vervalt de maandelijkse korting van 13,- per maand die je ontvangt bij een jaar lidmaatschap met betaling per maand. Hierdoor ben je betaalplichtig voor 3(maanden) x 13,- (verschil tussen 59,95 per maand en 46,95 per maand) = 39,- + het verschil in prijs van de prorato periode.
   – De betaling van de 39,- (+het verschil in prijs van de proratoperiode) dient uiterlijk op de laatste dag van de 3 maanden voor 00:00u betaald te zijn via de door ons, na ontvangst van het ingezonden “tevredenheidsgarantie formulier”, toegezonden betaallink.
   – Wanneer er sprake is van een prorato periode wordt het aantal trainingen naar rato van het aantal dagen van de proratoperiode verhoogt met x aantal trainingen per proratodag omlaag afgerond naar een heel cijfer.
   – geen enkele incasso/ betaling van lidmaatschapsgelden mag zijn gemist.
   – Het “tevredenheidsgarantie formulier” dient volledig en uiterlijk 3 werkdagen voor het einde van de 3de kalendermaand ingediend te zijn. Je krijgt bij het invullen direct een ontvangstbevestiging toegestuurd. Bewaar deze goed, dit is je bewijs mocht je onverhoopt bewijs nodig hebben. Ontvang je hem niet direct (check eerst je spam/ ongewenste mail op zowel via je telefoon als via een pc of laptop) neem dan binnen 24 uur per mail of whatsapp contact op met Lisa van onze klantenservice. Nogmaals, zonder de ontvangstbevestiging is je aanvraag NIET geldig/ ontvangen.

Artikel 12: Incassobureau stappenplan

1. Na de eerste mislukte automatische incasso zal GymBokx een herinnering sturen met daarin een betalingslink. De klant heeft vanaf het moment van versturen 5 werkdagen om deze betaling te voldoen. Wanneer deze niet binnen 5 dagen betaald is, zal GymBokx 10 werkdagen na de 1^eherinnering een tweede incassopoging doen. Wanneer ook de tweede incasso mislukt of wordt teruggetrokken gaat de factuur direct naar het incassobureau. Vanaf dit moment zullen alle vormen van communicatie via het incassobureau lopen. Toegang tot GymBokx zal worden geweigerd wanneer een van bovenstaande van toepassing is, pas nadat de betaling voldaan is zal deze weigering worden opgeheven.

Artikel 13: Kledingvoorschriften & handdoekgebruik

1. In de sportruimtes dient te allen tijde correcte sportkleding te worden gedragen. Daarnaast is het verplicht schone sportschoenen te dragen en een handdoek te gebruiken.

Artikel 14: Orde/instructievoorschriften

1. Het is niet toegestaan drugs, dan wel in zijn algemeenheid stimulerende middelen te gebruiken en/of te verhandelen. Gebruik/verhandeling van dergelijke middelen zal bij constatering leiden tot onmiddellijke ontbinding van het lidmaatschap, zonder dat enig recht ontstaat op restitutie van betaalde contributie.
2. Leden dienen zich te houden aan de door GymBokx (dan wel haar medewerkers) gegeven instructies en vastgestelde reglementen ten aanzien van onder andere kleding, noodzakelijke orde en discipline (gepaste kleding naar oordeel van Gymbokx, alsmede het uiten van luidruchtig gedrag en/of onbetamelijke taal, zulks naar het oordeel van GymBokx, dan wel de bij haar in dienst zijn de medewerkers). Bij overtreding is GymBokx gerechtigd om leden de toegang tot de club te ontzeggen en het lidmaatschap per direct te ontbinden, zonder dat enig recht op restitutie van betaalde contributie ontstaat.

Artikel 15: Veiligheid en aansprakelijkheid

1. Het gebruik van de faciliteiten binnen GymBokx geschiedt op eigen risico. GymBokx is niet aansprakelijk voor schade als gevolg van ongevallen, diefstal, brand of enige andere schadeveroorzakende gebeurtenissen, tenzij GymBokx hierbij opzet of grove schuld te verwijten is.
2. Het bewust of onbewust beschadigen van materiaal dat eigendom is van GymBokx zal geheel worden verhaald op de betreffende klant. Vanaf dat moment is de klant verantwoordelijk voor het schadeloosstellen van GymBokx, middels het betalen van een nieuwprijs voor het beschadigde object of middels tussenkomst van zijn of haar verzekeringsmaatschappij.

Artikel 16: Conformering overeenkomst

1. Ieder lid verklaart door ondertekening (middels versturing van een GymBokx inschrijfformulier, IDEAL-aanbetaling of machtiging tot automatische incasso) van de lidmaatschapsovereenkomst de door GymBokx opgestelde algemene voorwaarden en in de club gestelde huisregels na te leven. GymBokx is te allen tijde gerechtigd om eenieder die zich niet houdt aan de voorwaarden/regels de toegang voor een door GymBokx te bepalen duur te ontzeggen, zonder dat enig recht op restitutie van reeds betaalde contributie ontstaat.

Artikel 17: Gebruik lockers

1. GymBokx heeft een geselecteerd aantal kluisjes beschikbaar gesteld voor alle leden van GymBokx. Deze kluisjes mogen gratis gebruikt worden. Elk lid dient hiervoor een eigen hangslotje mee te nemen om het kluisje af te sluiten. Hangslotjes mogen een dikte hebben van 4-6mm.
2. Elk lid dient direct na het sporten, bij het verlaten van het GymBokx pand, het slotje mee te nemen en het kluisje leeg achter te laten. Aan het eind van elke dag zal het personeel van GymBokx hierop controleren. Achtergelaten spullen zullen bij de gevonden voorwerpen worden geplaatst. Hangslotjes van afgesloten kluisjes zullen worden verwijderd en vernietigd.

Artikel 18: Fraude

1. Alle zaken omtrent fraude zullen beboet worden zoals bij artikel 18.2 vermeld staat. O.a. zaken als niet eigenlijk gebruik van pasjes, overgeven van lidmaatschappen, het invullen en/of veranderen van onjuiste persoonsgegevens en andere frauderende zaken.
2. Bij overtreding van het in 18.1 bepaalde verbeurt GymBokx aan de klant een dadelijk en ineens zonder sommatie of ingebrekestelling opeisbare boete van€593,30 (Premium jaar betalen per maand lidmaatschap incl eenmalige kosten) voor elke overtreding, zonder dat GymBokx gehouden zal zijn schade te bewijzen en onverminderd het recht van GymBokx om schadevergoeding te vorderen, indien en voor zover de schade het bedrag van de boete overtreft.

Artikel 19: Fotografie en film

1. Bij het afsluiten van een lidmaatschap bij GymBokx stemt u in gefilmd en gefotografeerd te mogen worden binnen GymBokx of tijdens evenementen hiervan. Daarnaast stemt u ermee in dat dit foto- en filmmateriaal kan worden gebruikt op social media voor marketing doeleinde. Wanneer u wenst niet gefilmd of gefotografeerd te worden, dient u dit zelf aan te geven bij de filmende coach. U zal dan buiten beeld gehouden worden, of onherkenbaar gemaakt worden.

 Artikel 20: Overige bepalingen

1. Alle gevallen en/of situaties waarin bovenstaande algemene voorwaarden niet voorzien, worden uitsluitend door de directie van GymBokx beoordeeld. Alle geschillen die tussen GymBokx en leden ontstaan zullen worden beslecht door de ‘Geschillencommissie Fitness’ of de bevoegde rechter te Amsterdam.
2. Op het lidmaatschap is Nederlands recht van toepassing.

Artikel 21: Wijzigingsbeding

1. Wij zijn gerechtigd de algemene voorwaarden te wijzigen of aan te vullen. Kleine wijzigingen van ondergeschikt belang kunnen altijd worden doorgevoerd. Grote inhoudelijke wijzigingen zullen wij kenbaar maken.

By accepting the general terms and conditions you explicitly declare that you have read and will abide by the general conditions, house rules and payment agreements of VOF GymBokx. A membership only ends when the agreed contract period is terminated as described in our terms and conditions. A membership therefore ends not automatically, regardless of whether you train or not!

Article 1: Membership

1. Start:
   1.1 Every membership starts on the day of registration. Each membership starts on the 1st of the month. If you become a member during the current month, a fractional monthly amount will be charged pro rata, after which the first term of the membership (month, quarter or year) starts on the first of the following month.
   1.1.2 Each membership is compulsory for the minimum duration of one full calendar month.

All memberships run for the entire closed period, with the end date being moved in proportion to the duration of any pauses.

Article 2: Reflection period/ revocation

1. During a period of 14 days after signing the membership agreement, you have the option to cancel the contract free of charge.
2. The revocation right ends as soon as you make use of the facilities that GymBokx provides within the 14 days of the reflection period/ revocation. 

Article 3: Renewing/ converting membership

1. All memberships are automatically and tacitly renewed per month after the first agreed term.

2. Contract duration and extensions to guidance packages: Guidance package A: contract duration 2 months, extended per month Guidance package B, C and D: contract duration 4 months, extended per month
3. Get in Shape memberships will last for 13 weeks, 12 weeks for training and 1 week for testing.
4. You can convert your basic membership after the contractually agreed term per calendar month. You then submit the extension form which can be found       in the link or via the FAQ on the website. If not converted in writing in time,       the membership will automatically be extended by silence (see article 3.1).         During this period, the obligation remains to pay the fees due to GymBokx, even when the facilities may not be used.

Article 4: Upgrading membership.

1. It is possible to upgrade your Basic membership to a Premium membership within the chosen contract period. You then enter a new term that must at least have the length of your remaining current contract period. It is not possible to downgrade your basic membership.

 Article 5: Termination of membership

1. You can cancel via the FAQ on the website gymbokx.nl. If we have processed your cancellation, you will receive a confirmation e-mail within 5 working days. This e-mail is binding. Without this confirmation, your cancellation will not be valid. If you have not received a confirmation, it is up to you to contact GymBokx. Until then, you remain liable to pay.
2. You can cancel after the contractually agreed term every calendar month. If not cancelled in time, the membership will be continued for the agreed period. During this period, the obligation remains to pay contribution to GymBokx, even when you do not make use of the facilities that Gymbokx provides.It is not possible to cancel prematurely. The full number of months including the pro-rata period must be paid at all times.
3. GymBokx has no notice period.

Article 6: Pause membership

1. Memberships can be paused a single time per calendar year, for a maximum of three continuous calendar months, and only when a medical declaration is presented. You can request this pause via the website (LINK) where you can also submit your scanned medical declaration.
2. Pausing a membership afterwards is not permitted. The request for a break must be made before the break period. Pauses granted start from the first of the following calendar month.

Article 7: Membership strictly personal

1. Memberships only relate to the activities listed and the indicated duration and price. Unless explicitly stated otherwise, the membership is strictly personal, non-transferable and can only be used by and for the purchaser of the membership and club pass.
2. In addition to Article 7.1, the passing on of a club pass, and therefore a membership, to another person is strictly prohibited. If you violate this rule, you are committing fraud. See Article 18.

Article 8: Agreements

1. Appointments made with GymBokx must be cancelled at least 24 hours before the start of the appointment. If the appointment is not kept or cancelled in time, the credit for this appointment will expire.
2. When a new appointment is required, a new credit has to be purchased.
3. Personal Training appointments that have been canceled in good time, as referred to in Article 8.1, can only be made up within the period that is contractually agreed. See Article 3.2.

Article 9: Opening hours & rates

1. GymBokx is always entitled to change the opening times, class schedules and rates. During public holidays, GymBokx reserves the right to close the gym, without this leading to a reduction of membership fees or any refunds.
2. Changes in pricing will be implemented for both the new and current memberships.
3. Once a year, on 1 January, we may increase our rates by a maximum of 5% (excluding the level of the CBS price index figure for household consumption) per year from the last rate increase. If we make use of this, this does not give the right to terminate the agreement, unless the rate increase takes place within three months after the conclusion of the agreement or exceeds 5% (excluding the level of the CBS price index figure for household consumption). Rate adjustments due to government measures such as a VAT increase, without excluding other government measures, can be implemented immediately regardless of the amount and do not give the right to dissolution.
4. The leniency arrangement for an increase within 3 months is to divide the new amount per month by the remaining outstanding amount of the initial membership, so that a shorter membership duration remains and you do not pay more than the total amount of your entire membership that was initially agreed.
5. If no written objection is lodged within 4 weeks after the announcement of the increase, you agree to the price increase and the right to leniency or premature discontinuation lapses.

Article 10: Payment

1. By agreeing to our terms and conditions, you authorize the GymBokx centre where you register yourself to collect direct debit orders from your account in accordance with GymBokx’s instructions. If you do not agree with this depreciation, you can have it reversed. Please contact your bank directly within eight weeks of the debit. Ask your bank about the conditions.
2. The payment for the non-recurring costs (registration fee and club card) and pro-rata term of your membership has to be done directly upon registration, or, when registering online, at the latest before your first visit through payment via Ideal or by direct debit.
3. All memberships are automatically renewed after the first term (article 10b) according to the chosen method by means of direct debit. For that reason, you are obliged to give your IBAN for the monthly debit after this period, therefore you are also obliged to ensure sufficient balance on the account, from which GymBokx is authorized to collect.
4. The owed contribution is collected automatically and in advance per month, per quarter or per year (annually or per month).
5. If GymBokx has not received two consecutive direct debit orders, the full remaining amount of the entire membership will be due, and a debt collection agency will be involved. These costs are for your own account. Access to GymBokx will be refused until the payment is made.
6. The collection of owed payments that are not paid within the periods set by GymBokx are transferred to a collection agency. All judicial and extrajudicial (collection) costs that GymBokx must incur as a result of the non-fulfillment will be entirely at your expense. The compensation for extrajudicial costs is fixed at 15% of the principal sum due (with a minimum of € 40.00 per claim). In addition, statutory interest will be charged on the principal sum from the due date.
7. If GymBokx is unable to carry out a direct debit or in the event of a reversal, GymBokx reserves the right to terminate your membership immediately and to call a debt collection agency.

Article 11: Guarantee of results

1. The result guarantee only applies if the following conditions are met:
   In the case of the Get in shape program
   – 100% of the training must have been carried out by you, as prescribed. This concerns all 36 training sessions of 24 small group training sessions and 12 fitnesstraining sessions;
   – 100% of the prescribed (84) days you must enter your diet in the designated FOOD app;
   – Your weekly score in the FOOD-app must be at least 90% in every week.
   In the case of the guidance packages
   – 90% of the training sessions (3x per week) must have been carried out as prescribed by you.
   – 100% of the days you must enter your diet in the appropriate FOOD app
   – Your weekly score in the FOOD-app must be at least 90%.
   Every positive change falls under result. This therefore includes changes in weight, fat mass, muscle mass, fat percentage, muscle percentage, change in the circumference of the abdomen, legs and arms, improvement in scores on the fitness test (rowing test) and strength tests.

Article 12: Collection agency step-by-step plan

1. After the first unsuccessful direct debit, GymBokx will send a reminder containing a payment link. The customer has 5 working days from the moment the reminder has been sent, to fulfil this payment. If the sum is not paid within 5 days, GymBokx will make a second collection attempt 10 working days after the 1st reminder. When the second direct debit fails or is withdrawn, the invoice goes directly to the debt collection agency. From this moment on all forms of communication will run through the collection agency. Access to GymBokx will be refused if any of the above applies, and only after the payment is settled this refusal will be lifted.

Article 12: Clothing regulations & towel use

1. Sports clothing must be worn at all times in the training areas. In addition, it is mandatory to wear clean sports shoes and use a towel.

Article 13: Order/ instruction regulations

1. It is not permitted to use drugs and / or stimulants in general, neither to sell them. Use/ trafficking of such means will lead to immediate termination of membership, without any right to a refund of paid membership.
2. Members must adhere to the instructions given by GymBokx (or its employees) and set regulations regarding, among other things, clothing, necessary order and discipline (appropriate clothing in the opinion of Gymbokx, as well as the expression of noisy behaviour and / or indecent language in the opinion of GymBokx, or the employees employed by Gymbokx). In case of violation, GymBokx is entitled to deny members access to the club and cancel memberships immediately, without any right to a refund of paid membership fee.

Article 14: Safety and liability

1. The use of the facilities within GymBokx is at your own risk. GymBokx is not liable for damage resulting from accidents, theft, fire or any other damage-causing events, unless GymBokx is guilty of intent or gross negligence.

Article 15: Compliance agreement

1. Each member declares by signing the membership agreement (through sending a GymBokx registration form, IDEAL deposit or direct debit mandate) to comply with the general terms and conditions set by GymBokx and the club’s house rules. GymBokx is entitled at all times to deny anyone who does not adhere to the conditions/ rules access for a duration to be determined by GymBokx, without any right to a refund of contributions already paid.
2. The conscious or unconscious damage of material that is the property of GymBokx will be fully recovered from the relevant customer. From that moment the customer is responsible for compensating GymBokx, by paying a new price for the damaged object or through the intervention of his or her insurance company.

Article 16: Use of lockers

1. GymBokx has provided a selected number of lockers for all members of GymBokx to use free of charge. Each member must bring their own padlock to close the locker. Padlocks may have a thickness of 4-6mm.
2. Each member must take their padlock and leave the locker empty after training and when leaving the GymBokx facility. The GymBokx staff will check this at the end of each day. Items left behind will be placed with the lost and found objects. Padlocks found at the end of the day on used lockers will be removed and destroyed.

Article 17: Fraud

1. All matters relating to fraud will be fined as stated in article 18.2. These can be matters such as non-actual use of membership passes, transferral of memberships, filling in incorrect personal information and/ or changing it and other fraudulent cases.
2. In case of violation of the decrees in 18.1, GymBokx can debit to the customer an immediate and suddenly claimable fine of €593,30(Premium year payment per month membership including one-off costs) for any violation without summons or notice of default, without GymBokx being liable to prove damage and with GymBokx having the right to claim compensation when the damage exceeds the amount of the fine.

Article 18: Photography and film

1. At the moment of subscription to a membership at GymBokx you agree to be filmed and photographed within GymBokx as well as during events organised or attended by Gymbokx. You also agree that this photo and film material can be used on social media for marketing purposes. If you do not wish to be filmed or photographed, you personally must declare this to the coach that is filming and/ or photographing. You will then be left out of the picture or made unrecognizable.

Article 19: Other provisions

1. All cases and / or situations not covered by the above general terms and conditions are assessed exclusively by the Board of Directors of GymBokx. All disputes arising between GymBokx and members will be settled by the Fitness Disputes Committee or the authorised judge in Amsterdam.
2. Dutch law applies to membership.

Article 21: Amendment clause

1. We are entitled to change or supplement the general terms and conditions. Minor changes of minor importance can always be implemented. We will make major substantive changes known.
